Jaguar Land Rover Limited, of registered address Abbey Road, Whitley, Coventry, CV3 4LF ("Land Rover") agrees to provide the Event Package subject to the following terms and conditions:
"Agreement" means these terms and conditions, including the Booking Form as may be amended as agreed by the Parties in writing from time to time;
"Confirmation" means the confirmation of booking which Land Rover will send to the Customer to confirm the booking of the Event Package.
"Customer" means the individual or company booking the Event Package;
“Guest” means the plus one that each Customer is allowed to bring to the Event;
“Event” means the showroom preview event at the Retailer’s premises identified in the Agreement
“Land Rover Staff or Product Experts” means any member of staff working on behalf of Jaguar Land Rover for the Event or members of staff from the Land Rover Retailer where the event is being held.
"Parties" means Jaguar Land Rover and the Customer, and "Party" shall mean either of them as the context so requires.
"Premises" means the specified venue at which the Event Package booked by the Customer is to take place, as detailed in Land Rover’s Confirmation;
“Retailer” means a Customer’s local Land Rover retailer or the retailer the customer chose to attend the event
2. BOOKING ONTO THE EVENT AND CONFIRMATION OF BOOKING
2.1. A booking can only be made by completing the New Range Rover Evoque Preview Event form hosted on landrover.co.uk or Land Rover Retailer invitation emails. The booking is an offer by the Customer which Land Rover is free to accept or decline in its absolute discretion.
2.2. Where the Customer’s booking request has been successful, Land Rover will endeavour to notify the Customer of the same, either by email or telephone, within 5 working days of the booking request being made on the Land Rover website. In any event, Confirmation will be emailed to the Customer. The booking will only be binding once confirmed by Land Rover.
2.3. Where the Customer’s booking request is unsuccessful due to the Event being at full capacity, the Customer will be given an option to enter a waiting list (the “Waiting List”).
2.4. Where the Customer has been added to the Waiting List, confirmation of the same shall be emailed to the Customer or the Customer will be contacted by telephone. This does not constitute a booking for any Event.
2.5. The Customer shall be notified by telephone or email should a place at the Event become available. The booking will only become binding once confirmed by Land Rover.
2.6. Other than your guest (if you have already booked your guest in), there is limited provision for children.
3. CUSTOMER’S OBLIGATIONS
3.1. The Customer shall (and ensure that any Guest is aware that they also shall):
3.1.1. be responsible at all times for the safety and security of any items belonging to them and brought to the Premises by them. Land Rover will not in any circumstances be liable for any loss or damage to any such item howsoever arising. There is limited space available at the Premises and Participants should therefore refrain from bringing large items or luggage to the Event; and
3.1.2. not bring any of the following items onto the Premises without the prior written consent of Land Rover: flammable, combustible or objectionable substances or liquids; fireworks; cameras; camcorders; any other substance or item which is likely, in Land Rover's reasonable opinion, to present a health and safety hazard or other risk to persons at or property of the Premises.
3.2 Customers and Guests must not, at any time, act in a manner which is threatening, abusive or insulting or any manner which may, in our opinion cause harassment or distress to any other person;
3.3 Land Rover reserves the right to exclude any Participant who does not comply with the above requirements or who is suspected of being under the influence of alcohol and/or drugs.
4. TERMINATION AND CHANGES TO THE EVENT
4.1. Land Rover may immediately terminate this Agreement without notice in the event that the Customer or their Guest: (i) does not comply with its obligations hereunder; (ii) refuses to comply with the reasonable instructions of Land Rover Staff; (iii) deliberately or negligently damages the vehicles, Premises or any property located at the Premises; or (iv) behaves in an inappropriate or unacceptable manner. In such instances, Land Rover reserves the right to ask the Customer and their Guest to leave the Event immediately and there shall be no compensation due to the Customer.
4.2. Land Rover shall notify the Customer in writing (which shall include email) of any alteration to the Event which, in Land Rover’s reasonable opinion, substantially affects the Customer.
4.3. Land Rover reserves the right to cancel or alter the Event if it is unable to perform its obligations under this Agreement due events beyond its reasonable control to war, an act of terrorism, strikes, industrial action short of a strike, import or export embargo, lockout, accident, fire, blockade, flood, natural catastrophe or other obstacle over which Land Rover has no reasonable control. On the occurrence of an aforementioned obstacle, Land Rover shall be under no further liability to the Customer.
4.4. In the event that the Customer wishes to cancel or amend its booking, the Customer shall promptly communicate the same to Land Rover. Amendments or cancellations to a booking will be treated sympathetically but no guarantee can be given to revise previous arrangements. Any itineraries provided are given as an approximation and times may vary on the day.
5. USE OF PERSONAL DATA
6.1. Nothing herein shall be deemed to exclude liability for death or personal injury caused by negligence on the part of either Party, or for fraud, fraudulent misrepresentation or any other matter for which liability cannot be lawfully excluded or limited.
6.2. The Customer shall fully indemnify and keep indemnified Land Rover for all liabilities, costs, expenses, damages and losses (including, but not limited to, any direct, indirect or consequential losses, loss of profit, loss of reputation and all interest, penalties, and legal and other reasonable professional costs and expenses) suffered or incurred by Land Rover arising out of or in connection with any act or omission of the Customer, including, without limitation, in relation to any breach by the Customer of its obligations hereunder.
6.3. Land Rover shall under no circumstances be liable to the Customer for any loss of profit, loss of business, business interruption or loss of business opportunity arising out of or in connection with these terms and conditions.
7. GENERAL PROVISIONS
7.1. Land Rover has the right to remove and dispose of any goods or articles left on the Premises after the Event has ended without any liability whatsoever.
7.2. The Customer acknowledges and agrees that Land Rover is not responsible for its costs and/or expenses (including travel expenses) of attending the Event.
7.3. Any complaints in relation to the Event should be made in writing and sent to Customer Relationship Management Centre, Jaguar Land Rover Limited, Abbey Road, Whitley, Coventry CV3 4LF.
8. GOVERNING LAW
This Agreement and any non-contractual obligations arising out of this Agreement shall be governed and construed in accordance with the Laws of England and Wales and the parties hereby irrevocably submit to the exclusive jurisdiction of the English courts.

9. PHOTOGRAPHY / AUDIO / VIDEO
9.1. By agreeing to the term and conditions, you agree that any photographs taken, images other recordings in any medium captured during the event are the property of Land Rover and may be used and reproduced by us (in whole or in part) for future marketing/promotional purposes.
